Responsibility For Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on observation, the director did not comply with the section cited above as LPA observed school age child walk into the cafeteria, and into the school age room to drop off his back pack with out adult supervision. Two teachers on the play ground providing supervision which poses an immediate health, safety or personal rights risk to persons in care.

Indoor Activity Space for School-Age Children In combination programs, indoor activity space provided for school-age child care center children shall be physically separated from space provided for... child care center children. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in that LPA observed school age and preschool children utilizing the outdoor play area together and preschool children walking through the school age classroom to access the cafeteria while school age children were in the class which poses a potential health, safety or personal rights risk to persons in care.
Lead Testing (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on interviews and record review, the licensee did not comply with the section cited above The facility has not completed the required water testing for lead exceedance. This poses a potential health, safety or personal rights risk to persons in care.
