Outdoor Activity Space (e) As a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPA observed areas under slides and swings in the preschool play yard did not have enough woodchips to cushion falls. The woodchips were sparse and exposed the hard dirt under which poses a potential health, safety or personal rights risk to persons in care.
(a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement was not met as evidenced by: based on observation, interviews, and records review, Staff #1 did not ensure children were at a safe distance prior to closing the door on a child's finger causing a severe injury. Staff also did not secure the door closed after the incident, allowing children to exit to the playground without a teacher present which poses an immediate health, safety or personal rights risk to persons in care.

Activities/Napping (c) A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPA observed one staff member supervising 29 children napping which poses a potential health, safety or personal rights risk to persons in care.
The Licensee shall provide care and supervision as necessary to meet the children’s needs. No child shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230 (c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by Director self-reporting incident. On 03/05/2024, Child 1 exited the facility through a side playground gate unsupervised. This poses an immediate risk to the health, safety, or personal rights of children in care.

This requirement was not meant as evidenced by Director stating that the cement work to the playground was completed at the end of January. Director also stated that construction to the playground began on 03/05/2024. This poses a potential risk to the health, safety, or personal rights of children in care.
