Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in 1 out of 14 children were in the classroom hiding when the rest of the class was outside playing, leaving the child without supervision of a teacher for an undisclosed amount of time which poses an immediate health, safety or personal rights risk to persons in care.

The name of the child care center director, and any fully qualified teacher(s) designated to act in the child care center director's absence, shall be reported to the Department within 10 days of a change of child care center director or designee. This requirement was not met as evidenced by records review. During today's inspection, LPA found that the facility has a new Director/Principal; however, all required information has not been reported to the Fresno Community Care Licensing Office. This poses a potential risk to the health, safety, or personal rights of children in care.

Any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes. This requirement was not met as evidenced by LPA's observations. Today LPA observed in area accessible to children on the southern end of playground, an industrial sized sealed container of liquid, four pallets of flooring material and two large rolls of smart turf. This poses a potential risk to the health, safety, or personal rights of children in care.
