- All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by LPA's observations & information obtained by LPA during interview. Today, LPAs witnessed Staff #1 at the facility while children are in care. During records review, LPA confirmed that Staff #1 is not fingerprint cleared through the Department, and associated to this CCC as required. This poses an immediate health, safety, or personal rights risk to children in care. A civil penalty of $300.00 was assessed.
