Personal Rights(a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication, or aids to physical functioning. This requirement was not met as evidenced by: Based on LPA observations and interviews conducted; Staff left child in soiled clothing for longer then 15 minutes. This is a potential risk to the health, safety, or personal rights of children in care.

101238 Buildings and Grounds (a)The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement was not met as evidence by; LPAs observed that three areas of the fence, surrounding the playground was loose on the bottom, that a child could fit under and possibly get out. LPAs observed that the rubber flooring is uneven and can pose a tripping hazard. LPAs observed that the sandbox was hard and bare, and provided no cushioning. This poses a potential risk to the health, safety, or personal rights of children.
