In addition, a written report... shall be submitted... within seven days.... (1) Events reported shall include... (c) any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidenced by: Based on records reviewed, interviews and observation, Licensee failed to report incident of staff causing an injury to a child. This poses a potential health, safety, or personal rights risk to persons in care.

Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met based on evidenced of records reviewed, photos and interviews. LPA Gibson obtained corroborating interviews, photos, and documentation that revealed staff/witness #5 caused an injury to a daycare child. This posed an immediate risk to the health, safety and or personal rights to children in care.
