Criminal Record Clearance. All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department This requirement was not met as evidenced by: Based on interview and record review, S1 was working with children at the facility without an associated criminal record clearance, which poses an immediate health & safety and personal rights risk to the children in care.
Care and Supervision. No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews conducted by the LPA and the center director’s own admission, it was corroborated that on 04/02/26 at approximately 09:30am, child C1 was without supervision of a teacher for approximately two minutes while in the classroom before being reunited with their class. This posed a potential health, safety or personal rights risk to persons in care.
Criminal Record Clearance. However, S1 was not listed on the facility’s personnel roster and does not have an eligible California clearance on file. This poses/posed a potential health, safety or personal rights risk to persons in care.
Reporting Requirements. (b) The name of the child care center director, and any fully qualified teacher(s) designated to act in the child care center director's absence, shall be reported to the Department within 10 days of a change of child care center director or designee(s). This requirement was not met as evidenced by: Based on an interview with the facility’s new center director, Mario Zettler, on February 18, 2026, it was confirmed that the former center director, Mackenzie Miller, is no longer employed at this facility, with her employment ending in November 2025. The Department was not notified of this change. This poses a potential risk to persons in care.
