Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement was not met as evidenced by: based LPAs review of staff (S1) records. This revealed that S1 was missing proof of immunity against Pertussis. This poses/pose a potential health, safety, and/or personal rights risk to the children in care.

This requirement was not met as evidenced by: Based on LPAs file review of staff (S1) record which revealed that S1 was missing evidence of negative TB clearance.This poses/pose a potential health, safety, and/or personal rights risk to the children in care.
The licensee shall provide a copy of the Department Issued Addendum to Notification of Parent's Rights (Regarding Removal/Exclusion) (LIC 995B Rev. 05/03) sent by the Department, that is still in effect, to one parent or authorized representative of every child when the parent or authorized representative arranges for child care services or on the first day the child receives care, whichever is first. This requirement is not met as evidenced by: Based on review of children records, the records were missing signed copies of Addendum to Notification of Parents’ Rights form LIC 995B. This posed a potential health, safety and/or personal rights risk to children in care.
In addition to the events specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C), the licensee shall report the following events to the Department: Any suspected child abuse or neglect, as defined in Penal Code Section 11165.6, of any child in care, in addition to reporting requirements 11166. This requirement is not met as evidenced by: Based on an interview, Licensee did not notify and/or submit a UIR to CCL. This posed a potential health, safety and/or personal rights risk to children in care.
Each child receiving services from a family child care home shall have certain rights… These rights include, but are not limited to, the following… To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Based on interviews and law enforcement reports/records obtained by IB, which confirmed C1 & C2 were sexually abused by C3, which posed an immediate health, safety, and/or risk personal rights risk to children in care. A Civil Penalty of $2000 is being assessed for sexual abuse of a child(ren) in care.

These rights include, but are not limited to, the following: To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement was not met as evidenced by: Based on interviews, records obtained, and observations, C1 did sustain bruising which was undetermined. This posed an immediate health, safety and/or personal rights risk to C1.
