Responsibility For Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above. LPA observed two children walk out of room 1 back door and walk to room 2 side door without supervision which poses an immediate health, safety or personal rights risk to persons in care.
To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by a child who is allergic to dairy which is noted in child's file on form LIC702 and LIC627, was given dairy products on 07/26/2021 in the form of buttered popcorn. Staff did not realize the butter in the popcorn would cause a reaction. This poses a potential risk Health, Safety Personal Rights risk to children in care.
Teacher-Child Ratio There shall be a staffing ratio of one teacher and one aide present to every 28 children in attendance. This requirement was not met as evidenced by LPA observed 19 children with two adults in room 1. Neither adult in room 1 had evidence of completion of the required college course work on file. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.
