(a) Notwithstanding Section 101230, the following shall apply: (3) All infants shall be given the opportunity to sleep without distraction or disturbance from other activities at the center whenever the infant desires. (B) No infant shall be forced to sleep, to stay awake or to stay in the designated sleeping area. Based on the facility's self report and interviews, the licensee did not comply with the section cited above when a staff used water to keep an infant awake, which violates the personal rights of the infant in care and poses a potential health or safety risk to persons in care.
