This requirement was not met as evidenced by: Based on interview, record review and licensee’s admission, the licensee did not comply with the section cited above in that the licensee initiated communication with reporting party via text message after a complaint was filed for the facility which poses a potential health, safety, or personal rights risk to persons in care.
(d) Prior to employment or initial presence in the child care home, all employees and volunteers subject to a criminal record review shall: (1) Obtain a California clearance or a criminal record exemption as required by law or Department regulations This requirement is not met as evidenced by: Based on observation, interview and record review, the licensee did not comply with the section cited above in that (2) out of (2) persons working/residing in the home did not have a criminal record background clearance which poses an immediate health, safety or personal rights risk to persons in care.
