Food Service (1) All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above in that expired milk was found in one classrom and in the kitchen which poses a potential health, safety or personal rights risk to persons in care.

Personal Rights - (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as evidenced by: On 12/07/22, staff did not attend to a child that was crying at the playground as she had urinated on her clothes, shoes and was soaked in urine. This poses a potential risk to the health and safety of children in care.
Teacher Qualifications and Duties (b) Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below:(1) A teacher shall have completed.. or shall have obtained a Child Development Assistance Permit issued by the California Commission on Teacher Credentialing. This requirement was not met as evidenced by: Based on record review staff Destiny Patricio is not a fully qualified teacher because she is missing units in Child Family and Community. Ms. Patricio is not currently enrolled in any Child Development Course.
RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION (1) No child(ren) shall be left without the supervision... Supervision shall include visual observation. This requirement was not met as evidenced by: Based on staff interview and document received the facility failed to provide visual supervision resulting to a child leaving the classroom.

This requirement is not met as evidenced by: Based on interviews conducted, C1 was left without the visual observation of a teacher. C1 climbed up a play structure, was unable to stretch to reach a platform and fell 5 feet to the ground sustaining injury. This poses a potential health and safety risk to children in care.
