- Criminal Record Clearance All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f) This requirement is not met as evidence by S1 and S2 was working at the faciltiy prior to their background clearance being associated to the facility. S1 is no longer an employee at the facility and S2 worked at the faciltiy for a couple months prior to being associated to the facility. Civil penalty of $1000 is being assessed today.
