101229(a)(1) Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews, document review, and video footage obtained the facility did not comply with regulation above wherein two daycare children were left unsupervised. Due to the lack of supervision the children were able to leave the facility and reach the facility's parking lot during busy pickup traffic. This posed an immediate health and safety risk to children in care.

Buildings and Grounds (e) All licensees shall ensure the inaccessibility of pools, including swimming pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds or similar bodies of water, through a pool cover or by surrounding the pool with a fence. This requirement is not met as evidenced by: Based on LPA's observation, the licensee did not comply with the section cited above. LPA observed a body of water in the children's play area. Ms. Sirota stated that this area is filled with water in the morning and it drains out within an hour. Ms. Sirota also stated that she has designated an aide to supervise the outdoor area at all times. LPA observed the body of water with about 1 inch to about 6 inches of water. The area size is about 20 ft. by 20 ft. This poses an immediate health, safety or personal rights risk to persons in care.

Admissions Agreement. The licensee shall comply with all terms and conditions set forth in the admission agreement. This requirement was not met as evidenced by: Based on interview and review of the signed Adminissions Agreement connected with the Parent Handbook stating all policies will be strictly enforced. The facility was not enforcing it's requirements for visitors to check in at the preschool office and wear identification. This is a potential risk to the health and safety of children in care.
