101223 Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain... This was not met as evidenced by: Based on observation, interview and video footage obtained, Facility self reported a Staff member inappropriately handed a child in care. Admission Agreements: The licensee shall comply with all terms and conditions set forth in the admission agreement. Based on interviews and records review, the licensee did not comply with the section cited above. In reviewing facility files, there was no proof that the facility informed the parent/legal guardian of any behavioral issues concerning their child(ren). Also no information/proof obtained that, if, there were any behavioral issues, what effort was made by the facility to rectify the situation before termination. This poses a potential health, safety, or personal rights risk to persons in care.
Personnel Requirement - Request a transfer of a criminal record clearance as specified in Section 101170(f). This requirement was not being met as evidenced by the observation made by the LPA that staff Kathia Gonzales was providing care and supervision to children in care however, staff was/is not associated to the facility. This poses an immediate risk to the health, safety, and personal rights of the children in care. This citation comes with a $500.00 civil penalty, which will be issued today
