(a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based on interview & record review, the facility did not prevent a child in care from being "smacked" on the butt with a toy, multiple times, by a temporary staff member. The "smacks" would not be considered "gentle" and would not be considered "hard" either. This poses/posed a potential health, safety, or personal rights risk to persons in care.
Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review and interview, the licensee did not comply with the section cited above in that 1/5 staff members (Staff 3 [S3]) did not renew their mandated reporter training every two years, their last mandated reporter training expired 2/28/2026. Buildings and Grounds (g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. This requirement is not met as evidenced by: Based on observation the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. LPA observed during the tour in one of the classrooms a mop with cleaning solution attached to it was on the floor in the bathroom and accessbile to the children. LPA observed no children were in the bathroom at the time of inspection.

Criminal Record Clearance - All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the Department. Based on observation and record review, the facility did not meet the regulation above. Staff without a Criminal Record Clearance/exemption was providing care and supervision to children in care. This poses an immediate risk to the Health, safety, and personal rights to the children in care.
