Staffing Ratio and Capacity (b) For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be one of the following: (3) More than six and up to eight children, without an additional adult attendant, only if the criteria in Section 1597.44 of the Health and Safety Code are met. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above in that from 1:15pm to 2:00pm the facility did not have an assistant present. The facility had 8 total children present with 3 of them being infants. The regulations state that there can only be 2 infants present when there are 8 total children present. This poses an immediate health, safety or personal rights risk to persons in care.

Operation of A Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. (A) Storage areas for poisons, firearms and other dangerous weapons shall be locked. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in that their were 2 cleaners that noted to call poison control if ingested. These 2 poisons were not accessible to children in care and were in a cabinet that did not have any handles, that was also barricaded by a heavy stepping stool. However, this does not count as being "locked" per the above regulation. This poses/posed a potential health, safety or personal rights risk to persons in care.

Operation of A Family Child Care Home (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above in that the Licensee Lencee Harris was not present at the facility the entire day. Even though 1 of the 2 licensees has been present the entire day, the Licensee Lencee's temporary absence has exceeded more than 20% of the hours that the facility operates, which poses/posed a potential health, safety or personal rights risk to persons in care.
