1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review and interview, the licensee did not comply with the section cited above in that Staff 2 (S2) and Staff 5 (S5) did not complete renewal of madated reporter training every 2 years. S2's mandated reporter training needed to be renewed by 8/27/2025 and S5's mandated reporter training needed to be renewed by 10/20/2025. This poses/posed a potential health, safety or personal rights risk to persons in care.

This requirement was not met as evidenced by: In or about June 2021, there had been at least two different occasions that children were left unsupervised while staying in the front office area waiting for additional teaching staff to arrive to work in the morning. The children were in the hallway around the corner of the front counter and in the staff room without any staff member physically present with them in the same area. That presented immediate risks to the children's health and safety.
Personal Rights. The licensee shall ensure that each child is accorded...accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: In or about June 2021, due to insufficient teaching staff to maintain proper teacher-child ratio in the class, some children were made to stay in the front office, staff room and the director's office with office staff for extensive period of time. That was a violation of the children's personal rights as those areas are not licensed as part of the child care activity areas and not age-appropriate for the children.
