(a) There shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity. This requirement is not met as evidenced by: Based on interview and record review the licensee did not comply with the section cited above in that during construction on one... playground, the facility did not provide any outdoor activity space for children and did not have a waiver for this requirement. The facility did provide active play space indoors for children during construction. This poses a potential health, safety, and/or personal rights risk to persons in care.
