Teacher Qualifications and Duties (b) Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below: (1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1) below; or shall have obtained a Child Development Assistant Permit issued by the California Commission on Teacher Credentialing. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above as LPAs observed that of the 6 staff observed in the 4 preschool classrooms, only 2 staff were determined to be qualified as teachers, while the other staff have certificates on file whose accreditation could not be validated at this time which poses a potential health, safety or personal rights risk to persons in care.

(a) The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons. Based on LPAs own observations and staffs own admission, the facility did not comply with the section cited above. Staff have not been according children in their personal relationships with staff/other persons. Staff are yelling at, pulling and grabbing children. This poses an immediate health and safety risk to children in care.
