101229 Responsibility for Providing Care and Supervision: (a)(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This was not being met as evidenced by video footage showing staff not having visual observation of Child 1 (C1) as C1 exited the exterior gate of the facility, then walked back and entered back through the exterior gate. This poses an immediate health, safety or personal rights risk to children in care.

Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above in that 1 out of 4 staff (Staff 1 [S1]) did not have a completed renewal of mandated reporter training which satisfies Assembly Bill 1207. LPA did observe that the staff member had mandated reporter training that satisfies only Assembly Bill 1432 & 1913. This poses/posed a potential health, safety or personal rights risk to persons in care.

Lead Testing (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in identifiers which poses a potential health, safety or personal rights risk to persons in care. LPA observed during record review the lead testing was not conducted. Program Admin stated the testing is scheduled for 8/31/23.
