The Department shall have the authority to suspend or revoke any license for the following reasons: (3) Conduct in the operation or maintenance of a family day care home which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of the State of California.

The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family childcare home. This requirement was not met as evidenced by: Licensee was notified of an allegation of sexual abuse committed by an adult in the home and failed to report this Unusual Incident to the Department.
Personal Rights. Each child receiving services from a family childcare home shall be accorded dignity in his/her personal relationships with staff, residents and other persons. This requirement was not met as evidenced by: Adult #1 abused Child #1 on three occasions the same day at the facility, which poses an immediate risk to the health, safety or personal rights to children in care.
