This requirement was not met as evidenced by: Based on interview and observation, the licensee did not ensure all vehicle occupants were secured in an appropriate restraint system by transporting 9 children in a car that only had 7 available seats, which poses an immediate Health, Safety, and/or Personal Rights risk to persons in care.

Staffing Ratio and Capacity (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement is not met as evidenced by: Based on interview, the licensee did not comply with the section cited above by providing care for over eight children without an assistant present which poses an immediate health, safety or personal rights risk to persons in care. Licensee informed LPM/LPA that she has provided care for 13 children alone for 4/5 months, due to not having a reliable assistant.
