Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above due to having a above-ground pool that was not fenced nor had the appropriate covering. Which poses an immediate health, and safety risk to persons in care.

(A) Storage areas for poisons, firearms and other dangerous weapons shall be locked. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. Licensee did not ensure to keep insect poison locked away. Licensee had it on a shelf in the hallway closet. Licensee explained she thought it just needed to be out of the reach of children.
