This poses an immediate risk to the health, safety, and personal rights of children in care.
Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment…or other actions of a punitive nature… This requirement was not met as evidenced by: Licensee stated that Staff #1 grabbed a child by their hands and held them in the child’s lap, thereby restraining the child. This is a health and safety risk to children in care.
(b) Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below: (1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1)...The units specified in (c)(1) above shall include... chld, family, and community... This requirement was not met as evidenced by: LPA observed Staff #1 being utilized as a qualified teacher with an aide, however staff file review revealed Staff #1 was not qualified. This poses an immediate risk to health and safety of the children.
