Operation of A Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. During the tour of the facility LPAs observed an above ground pool installed in the off limit area of the facility. There are two gates leading to the pool from the children's outdoor area to which one of the gates is not self closeing and self latching. There is also direct access to the pool from the sun room with one window leading facing the pool that is not barricaded. A civil penalty in the amount of $500.00 is assessed for zero tolerance violation.

This requirement is not met as evidenced: LPAs observed an above ground pool installed in the backyard. The pool is not properly surrounded by a fence as required. Failing to report pool installatiion is a potential risk to the health and safety of children in care.
