Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.This requirement was not being met as evidenced by: Based on interviews conducted, and staff admission, C1 was placed inside a restroom with the door closed while having a behavioral episode. This is a potential personal rights violation to children in care.
Reporting Requirements: (d) Upon the.. child care.. in (d)(1) below, a report shall be.. fax within the Department's.. In addition, a written.. specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events..:(C)Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not being met as evidenced by: Based on interview and record review, the facility did not submit a UIR regarding the incident that occurred on 12/16/2026 involving C1 and C2 where C1's nose bled as a result of being slapped by C2. This is a potential health and safety risk to children in care.
