(a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based on interviews and record review, LPAs reviewed documentation of 20+ incident reports for a child that has been scratching other children, starting in January of 2024 which poses an immediate health, safety, or personal rights risk to persons in care.
(1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above as it was reported that a day-care child was left alone in a classroom during transition time which posed an immediate health, safety or personal rights risk to persons in care.
(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based on interview and record review, it was determined that a child was kept in the isolation bathroom rather than the main isolation area for approximately 1.5 hours despite the child's symptoms not needing restroom amenities to treat which poses a potential personal rights risk to children.
(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from... infliction of pain... This requirement was not met as evidenced by: Based off of interview and record review, the facility failed to ensure children's Personal Rights due to staff not properly assessing child injuries and the elbow injury a day-care child sustained as a result of improper lifting which poses an immediate risk to the Personal Rights of children in care.
(e) All individuals subject to a criminal record review...shall prior to working, residing or volunteering in a licensed facility: (2) Request a transfer of a criminal record clearance as specified in Section 101170(f) This requirement is not met as evidenced by: Based on observation, record review and interviews the facility did not comply with the section cited above as LPAs observed one staff member present engaging with the day care children and who was not associated to the facility, which poses an immediate health and safety risk to persons in care.
Lead Testing (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above as the facility has not yet tested for lead exceedances which poses a potential health, safety or personal rights risk to persons in care.

Outdoor Activity Space (d) The surface of the outdoor activity space shall be maintained: (2) Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above as during the facility tour LPA observed the outdoor play area had a large wooden log which had one exposed side with sharp edges and peeling wood along with the outdoor play area having several holes in the ground in the dirt and grass area which poses a potential health, safety or personal rights risk to persons in care.
Personal Rights. (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment…or other actions of a punitive nature including but not limited to: interference with functions of daily living…aids to physical functioning. Based on reported information and interviews with pertinent parties, staff members had knowledge that this child was sensitive to sound and although the suspected staff member denies using the alarm to alter the child’s behavior, the involved child expressed to staff that he/she did not like the sound of a safety alarm; therefore, this poses an immediate health, safety, and personal rights risk to children in care.
(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles... This requirement is not met as evidenced by: Based on facility records review, Licensee did not have proof of immunizations for Staff #3 and Staff #4 available at the time of LPA's request. Staff #3 is missing proof of Tdap and Staff #6 is missing proof of MMR. This poses a potential health, safety or personal rights risk to persons in care.
