(a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: Based off of interview and record review, it was determined that the facility failed to ensure children's Personal Rights due to the high volume of biting incidents which poses an immediate risk to the Personal Rights of children in care.
Infant Care Center Sleeping Equipment (b) A crib or portable -crib meeting United States Consumer Product Safety Commission safety standards shall be provided for each infant who is unable to climb out of a crib. (1) Mattresses shall be firm and covered with a fitted sheet that is appropriate to the mattress size, fits tightly on the mattress, and overlaps the underside of the mattress so it cannot be dislodged. This requirement is not met as evidenced by: Based on observation, 2 out of 2 cribs did not have a fitted sheet that was meant for that specific mattress. Although there was no indication of the sheet being 'dislodged', it was definitely sitting loosely on the top side of the mattress, meaning the facility did not comply with the section cited above. This poses an immediate health, safety or personal rights risk to persons in care.
