General Provisions and Definitions (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on observations, interviews conducted, and records reviewed, the licensee did not comply with the section cited above as licensee did not ensure required immunizations were maintained for all personnel which poses a potential health risk to children in care.
Inspection Authority of the Department: Any duly authorized officer, employee, or agent of the Department shall, upon presentation of proper identification, enter and inspect any place providing personal care, supervision, and services at any time, with or without advance notice, to secure compliance with, or to prevent a violation of, the regulations adopted by the Department governing family child care homes, and in accordance with Section 102396. Based on actions that took place on 11/1/2022, the licensee did not comply with the section cited above.
Criminal Record Clearance (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department or This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. In reviewing facility file/record, it was determined that the licensee's adult son (Charles Andrews) resides at the home and has not obtained a Criminal Record Clearance. Prior to today's (11/1/2022) inspection, this issue was addressed by LPA Lopez on multiple occasions with the licensee. This poses an immediate health, safety or personal rights risk to persons in care.

(2) Any change in household composition including adults moving in or out of the home and anyone living in the home who reaches his or her 18th birthday. This requirement is not met as evidenced by: Based on record review and file, the licensee did not comply with the section cited above. The licensee's son (Charles Andrews) is over 18 years of age and resides at the home however, is not listed in the LIC 279 (Application for a Family Child Care License). This poses/posed a potential health, safety or personal rights risk to persons in care.
