Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement was not met as evidenced by: The velcro that keeps the padding on the basketball pole no longer stays closed and leaves the pole exposed which poses/posed a potential health, safety or personal rights risk to persons in care.
101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by an toddler getting their finger stuck inside a door jam.

This is an immediate health and safety risk to children in care.
Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on LPA observation and record review, the licensee did not comply with the section cited above in 3 out of 4 staff files which were found to have expired Mandated Reporter certificates. This poses/posed a potential health, safety or personal rights risk to persons in care.
Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not being met as evidenced by: Based on observation, staff interviews, and record review, the facility has not maintained a clean environment for children in care. This poses a potential health and safety risk to children in care.
Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following: (E) Epidemic outbreaks. This requirement was not being met as evidenced by: Based on record review, and staff interview, the facility did not report to CCL in reference to the outbreak. This is a potential health and safety risk to children in care.
Section 101700.3 (b) (1) California Lead Action Level at Child Care Centers 101700.3 (b) (1) Written Directives...A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement was not met as evidence by: Based on records review and interviews, facility tested over the Action Level Exceedance, in one drinking fountain located outside on the preschool/school age playground. This poses a potential health, safety, or personal rights risk to the children in care.
