PERSONAL RIGHTS (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as evidenced by: Based on observation and record review, S1 handled day care children inappropriately, staff used an inappropriate forms of discipline towards children in care, staff made inappropriate comments towards children in care, staff yells at children in care on one or more occasions by placing their hands on the child by grabbing and pulling the arms and shoulders and forcing the child to sit and listen, placing children in the restroom area for discipline, and telling children in care to go to the restroom and cry about it. This is an immediate health, safety and personal rights risk to children in care.
101229 Responsibility for Providing Care and Supervision. (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time >>>(e)(1) and 101230 (c)(1). Supervision shall include observations except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidence by staff #1 leaving the child in the classroom without making sure the child was safely escorted to the playground area.

Teacher Aide Qualifications and Duties: (d) An aide assisting a fully qualified teacher (as specified in Section 101216.1(c)) in the supervision of up to 18 preschool-age children...to Section 101216.3 shall meet the following requirements: (1) Completion of six postsecondary semester or equivalent quarter units in early childhood education or child development This requirement is not met as evidenced by: Based on interview with S1, and record review, the licensee did not comply with the section cited above where S2 was not qualified to assist a teacher as an Aide. This poses/posed a potential health, safety or personal rights risk to persons in care.

Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.
