Personal Rights. (a) The licensee shall ensure that each child is accorded the following personal rights: (2)To be accorded safe, healthful and comfortable accommodations... (3)To be free from ..., infliction of pain, humiliation, intimidation... This requirement was not met as evidenced gathered during the investigation shows that the facility failed to address continuing biting from Child 1, which posed/poses an immediate risk to the health and safety of children in care. This was corroborated by LPAs interviews with witnesses, file review, and documented evidence.
