The licensee shall provide care and supervision as necessary to meet the children's needs. No child shall be left without the supervision of a teacher at any time..Supervision shall include visual observation. This requirement is not met as evidenced by: Based on interview, the Facility did not ensure compliance of the section cited above as a child being left alone in the restroom without supervision, which poses an immediate Health,Safety, or Personal Rights risk to persons in care.
TEACHER-CHILD RATIO: There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This requirement is not met as evidence by the facility has been out of ratio in the mornings during drop off times leaving one teacher with more than 12 children on more than one occasion. This is an immediate risk to children.

PERSONAL RIGHTS: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidence by interviews indicated that staff has handled children in a rough manner by grabbing/ yanking children by the arm and yelling at day care children. This is an immediate risk to children.
