Personal Rights. (a) The licensee shall ensure that each child is accorded the following personal rights:(1)To be accorded dignity in his/her personal relationships with staff and other persons.(2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not as evidenced by interviews with staff and Licensee. Licensee stated that she swore during an argument with a former staff member in the presence of two children. Licensee stated that she previously engaged in an conversation regarding abortion with staff while in the presence of children. This is considered an immediate risk to the health and safety of children in care.
