Responsibility for Providing Care and Supervision.(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not med as evidenced by admission from the facility through self-reporting, staff interviews, and review of video footage. On 07/01/2026, Child 1 was left unattended on the toddler playground for approximately 1.5 minutes before they were observed by Staff 1. This is considered and immediate risk to the health and safety of children in care if not corrected.

Food Services. (7)Modified diets prescribed by a child's physician as a medical necessity shall be provided. (B) A child shall not be served any food to which the child's record indicates he/she has an allergy. This requirement was not met as evidenced by the facility reporting via Unusual Incident Report that on 08/01/2025, C1 was given dairy by Staff 1 during snack time. Facility has documentation via Health History and the Infant Needs and Services plan that the child shall not have dairy. This posed a potentital threat to the health and safety of the child in care.
