Personal Rights. The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by staff interviews and an Unusual Incident/Injury that was reported on 1/16/2026. On 1/15/2026, a window closed on the finger of Child 1, after Staff 1 opened the window, although there were signs on the window not to open it. Some staff were aware the the window needed repair for approximately 3 years, however a repair was not ordered until after the incident.

This requirement was not met as evidenced by staff interviews during the investigation. Staff interviews corroborated that staff knew windows at the facility were not functioning properly for approximately 3 years. Responsibility for Providing Care and Supervision.(1)No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Facility self-reported that on May 10, 2022, Child #1 was absent from the facility for approximatley 15 minutes, and found by the fire department at the playground of a neighboring facility. This is an immediate risk to the health and safty of children in care.
