Personal Rights. (a) The licensee shall ensure that each child is accorded the following personal rights:(1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as evidenced by staff interviews and a self-reported Unsual Incident Report from the facility. On 2/13/2025, Staff 1 forced Child 1's head down on their cot with one hand during nap time. This is an immediate risk to the health and safety of children in care.

Teacher-Child Ratio. (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. This requirement was not met as evidenced by LPAs observations. LPAs observed 13 children supervised by one staff in three separate classrooms. This occurred before Staff 2 arrived to assist a room in ratio. During the initial census LPA observed Staff 1 supervising 12 children before she was replaced in ratio by the director. Director stated that Staff 1 is an aide and does not have qualifications for a teacher. This is considered an immediate risk to the health and safety of children in care.

This requirement is not met as evidenced by: Based on observation and record review, the facility did not comply with the section cited above as LPAs observed Staff #1 and Staff #2 were observed supervising children in a preschool classroom, and both were determined to be aides, which posed a potential health, safety or personal rights risk to persons in care.
