(a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not as evidenced by: Based on interviews and record reviews, the facility did not comply with the section above in that S1 gave C1 was Oregano Spirits instead of their teething oil which caused C1 to have a rash.

This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above in that Child 1 (C1) was in the children's restroom without staff supervision, the children's restroom door were opened leading to the classroom and to the facility's main hallway, which poses an immediate health, safety or personal rights risk to persons in care.
