Observation of the child- The behavior and health of the children shall be continually observed throughout the period of attendance. The above requirement was not met as evidenced by a 4-year-old child (C1) found a Nicotine Vapor Pen on the playground and put it in their mouth. S1 unintentionally, forgot to secure their fanny pack in the locked closet, and did not realize vapor pen had fallen in the sandbox. Staff on the playground did not observe the behavior of the child adequately to prevent C1 putting it in their mouth. This is a potential risk to the health and safety of children in care.

C1 was locked in an outdoor restroom alone for 4 minutes without any supervision. This poses an immediate Health and Safety risk to the children in care.
