Lead Testing (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on observation, interview, and record review, The licensee did not comply with the section cited above. Lead testing was completed and did not meet the lead testing requirements, which posed a potential health, safety or personal rights risk to persons in care.
Criminal Record Clearance (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: This requirement is not met as evidenced by: Based on interviews conducted with the director, S3, and S1 and records review, the licensee did not comply with the section cited above in one out of one staff, which poses an immediate health, safety or personal rights risk to persons in care. Cynthia Castillo stated she has worked at the facility for 1 year. The director and S3 confirmed Cynthia has been working at the facility since approximately August 2022.

Each child day care facility shall maintain a current roster of children who are provided care in the facility. The roster shall include the name, address, and daytime telephone number of the child's parent or guardian, and the name and telephone number of the child's physician. This roster shall be available to the licensing agency upon request. This requirement is not met as evidenced by: Based on interview and records review, the licensee did not comply with the section cited above in 1 out of one children's roster, which poses/posed a potential health, safety or personal rights risk to persons in care. Per the director, the facility did not have a roster at the time of inspection. Director stated they would have to prepare one on the spot. The LPA provided a blank copy of the LIC9040.
