Pool Safety (ii) (I) An alarm that, when placed in a swimming pool, will sound upon detecting an entrance into the water. The alarm shall be turned on and be in working condition during a facility’s operating hours while the swimming pool is not in use. This requirement is not met as evidenced by: Based on observation and interview the licensee did not comply with the section cited above. During facility inspection of pool, LPA observed an alarm that was in the pool at the time of inspection that did not sound when water was splashed. Licensee stated it will need a new battery, which poses/posed a potential health, safety or personal rights risk to persons in care.

Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. Gate did not self-latch and licensee pushed the gate closed with her hand. Licensee stated that she has a key lock on the gate and keeps it locked. Gate did not self-latch which poses an immediate health, safety or personal rights risk to persons in care.
