General Provisions and Definitions (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on observation and record review, the licensee did not comply with the section cited above in 3 counts out of 10 counts of staffs' files which poses a potential health, and safety risk to persons in care. During file reviewing staff # 3 missing MMR, staff # 8 and staff # 9 missing MMR, and Dtap vaccines.
(a)The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by a self-report incident, staffs interviews, and reviewing documents, 2 year old child was left unattended on the playground during transitioning from playground to patio on 7/10/2025 for approximately 10 to 15 minutes. This is an immediate risk to the health and safety of children in care.
Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on observation, and record review, the licensee did not comply with the section cited above in 3 counts of 7 staffs' files that staff # 1, 5, and 7 missing the mandated reporter certificates which poses a potential health, and safety risk to persons in care.
Lead Testing (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above not testing the water for lead as it was required which poses a potential health, safety risk to persons in care.
Health-Related Services (e) In centers where the licensee chooses to handle medications: (1) All prescription and nonprescription medications shall be centrally stored in accordance with the requirements specified below: (B) Each container shall have an unaltered label. This requirement is not met as evidenced by: Based on observation of medication box at 10:30 am today, the licensee did not comply with the section cited above in child # 1's medication which was missing the original box and the medication label on the container which poses a potential health, safety risk to persons in care.
