Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced by: Based on LPA observation, D1 did not comply with the section cited above when 8 children and D1 were in an enclosed playyard. C6 opened the gate by themself, ran to a secondary gate (which lead to a side street) then exited by themself. After gathering the remaining 7 children, which took a few seconds, D1 was able to run after C6 with the remaining 7 children in tow. LPA observed C6 on the otherside of the street with D1 trying to cox him back to the facility side of the street. A few minutes passed until C6 willingly rejoined the group. No cars were observed to pass through. This poses a potential health, safety or personal rights risk to persons in care.

This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above when 8 of 8 preschool children were commingling with school age children in the schools playground (the picnic benches and grassy area, not the play structure) from approximately 11:30pm to 12:30pm which poses/posed a potential health, safety or personal rights risk to persons in care.
