Subsequent to initial licensure, a person specified in subdivision (b) who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification, pursuant to subdivision (f) of this section or Section 1522.7, from the State Department of Social Services prior to employment, residence, or initial presence in the facility. This requirement is not met as evidenced by: Based on interview and record review, the licensees did not compliance with the section cited above. LPA observed an adult household member (Staff #3(S3) live in the home with no background clearance associated with this facility. Licensees provided evidence that they have made attempts to have S3’s fingerprint background cleared. This poses a potential health, safety, or personal rights risk to children in care. *This is an amended report.”

(a) Prior to making alterations or additions to a family child care home or grounds, the licensee shall notify the Department of the proposed changed, including, but not limited to, the following: (3) Installation of in-ground or above-ground swimming pools, spas, fish ponds, decorative water feature, fountains or other bodies of water. This requirement is not met as evidenced by: Based on observation, the licensees did not comply with the section cited above. LPA observed an in-ground swimming pool in the backyard where children have access. Per Licensees, the installation of their in-ground swimming pools in the backyard started in November 2023 and completed around January 2024. Licensees failed to notify the Department of the installation of the in-ground swimming pool; therefore, it poses a potential health, safety, or personal rights risk to children in care.

Based on observation, the pool fencing did not meet the requirement as followed: the metal fence was not at least five high, plastic turquois netting fabric was installed around the fencing obscuring the view of the pool. The gate was not swing away from the pool, the gate was not self-close and self-latching, the device of the self-closing/latching are not located no more than six inches from the top of the gate.
