(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: based on video footage, Licensing Program Analyst (LPA) observed one teacher aggressively or roughly handling two (2) children during nap time. This poses a potential risk to the health, safety, or personal rights of children in care.

Administration of Child Day Care Licensing (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. During employee record review, Licensing Program Analyst (LPA) observed that two staff members were missing Mandated Reporter Training for Child Care Providers.

Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. During the indoor inspection, Licensing Program Analyst (LPA) observed dark staining in different areas of the brown carpet as well as staining on the colorful carpet used for circle time in the 4s classroom. LPA also observed several holes and frayed areas in the brown carpet. During the outdoor inspection, LPA observed that one of the wooden boards toward the bottom of the fence was broken, leaving a splintered area.
