101229(a)(1) (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time... specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews, staff confirmed that a child was left unsupervised in the outdoor play area for about seven (7) to eight (8) seconds, while everyone went back inside of the classroom. This poses a potential health, safety, or personal rights risk to children in care.

Lead Testing (1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. Per licensee, the facility has not been tested for lead. Licensee stated that the children do not drink from the drinking fountains and only drink bottled water. LPA reviewed the regulation for Lead Testing in centers opened before 2010.
