This requirement is not met as evidenced by: Based on LPA observations, staff iinterviews and records review, the licensee did not comply with the section cited above in that Outlet C Kitchen Sink located in the cafeteria is at ALE of 7.1 ppb. which poses/posed a potential health, safety or personal rights risk to persons in care.

California Lead Action Level at Child Care Centers (a) California’s Action Level for lead in water at Child Care Centers is 5 ppb. (b) Testing results with fractional ppb readings of 0.5 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. (c) If testing indicates an Action Level Exceedance at any water outlet, the water from that outlet is deemed not safe to drink and an immediate response pursuant to section 101704 shall be required. This requirement was not met as evidenced by: Based on record review provided by Licensee indicating (ALE of 6.7 ppb in Outlet A Classroom Fountain) and (ALE of 7.1 ppb in Outlet C Kitchen Sink). These results indicate over (ALE) 5.5 ppb, which is out of compliance. This poses a potential health, safety or personal rights risk to persons in care.

General Provisions and Definitions (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This requirement is not met as evidenced by: Based on LPA observation of staff files. LPA observed that two staff did not have documentation of measles and pertussis as required by regulations. This poses a potential health, safety or personal rights risk to children in care.
