Report finding: Pool Safety (a) A licensed family daycare home operated at a private single-family dwelling with an in-ground swimming pool on the premises shall comply with all of the following requirements: (1) The swimming pool shall be equipped with, at minimum, the following drowning prevention safety features: (A) An enclosure, including, but not limited to, a fence, wall, or other barrier that isolates the swimming pool from access to the family daycare home and has all of the following characteristics: This requirement is not met as evidenced by: Based on LPA observation and Licensee interview, the licensee did not comply with the section cited above in LPA observed in observed in off-limits backyard an above ground pool filled with water to the rim and observed there are 3 3x5 windows located in the off-limits master bath, bedroom 3 and bedroom 2 that has DIRECT access to the pool area which poses/posed a potential health, safety or personal rights risk to persons in care.

Report finding: (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department This requirement is not met as evidenced by: Licensee disclosed that Adult #2 was residing at the home but was currently at work. The uncleared adult was fingerprinted, however Adult #2’s status in guardian stated the clearance was currently "in process" as the clearance was not done properly. This poses a potential risk to the health and safety to children in care.
