This requirement was not met as evidenced by: LPAs observation. LPAs observed a broken safety latch in the kitchen where a knife was made accessible to children to care. Licensee was previously cited for this same violation. This poses an immediate risk to the health, safety, and personal rights of children in care. An immediate civil penalty of $250 was assessed.

- Personal Rights. To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This requirement was met as evidenced by licensee admitting to taking a fly swatter into the room when disciplining child #1. Child #2 sustained a scratch from licensee when she grabbed child #2 by the arm. The scratch broke the skin, and caused pain to the child. This is an immediate risk to personal rights, health and safety of children in care.
